How to Beat a DUI
If you are like most people who have been charged with driving under the influence, you probably feel hopeless and scared. However, just because you are charged with a DUI, it doesn’t necessarily mean that you will be found guilty of the crime. There are many skilled DUI attorneys out there who know how to beat a DUI.
The most common way to beat a DUI charge is by discrediting the evidence that is being used against you. There are two ways that the prosecution will try to prove that you were under the influence. One way is to use the officer’s testimony about your appearance and behavior to show that you were impaired by alcohol and/or drug consumption. The other way is to
present your blood or breath test results to show the judge and jury that your blood alcohol concentration (BAC) was over the legal limit.
There are typically four types of evidence that are used in a DUI case: the defendant’s driving pattern, the defendant’s appearance, the results of the field sobriety tests, and the results of the chemical test.
All of these types of evidence are open for debate.
For example, if the officer testifies that the defendant had bloodshot eyes, the defense attorney may argue that his client was tired or was taking allergy medication. If the officer says that the defendant was driving erratically and it is proven that the defendant’s driving pattern was normal, the case could even be thrown out because there was no probable cause for the initial traffic stop.
Field sobriety tests are far from perfect. If the officer did not properly administer the test, it could negatively affect the test results; likewise if the test was performed on uneven, wet, or slippery ground. There are also some physical issues that can prevent a person from performing the test correctly.
In addition, there are many known
problems with the breath test. Certain medical conditions, such as acid reflux or dental problems may inflate the test results. If the breath test machine is not calibrated or maintained correctly, it can also affect the results.
